Workers Compensation Insurance

If you are an employee, probably you are aware of the Workers Compensation Insurance.  This insurance is a protection to the employees.

Today, the law requires the employers to have this kind of insurance for their employees, wherein premium is usually paid by the employer.   This workers compensation Insurance pays the employee or gives monetary assistance in the event that the employee incurs damages when he is on the work place.   When an employee is injured during his time of duty he is entitled to claim this.  Meaning in any event that an employee is injured as long as it is job related the insurance has to pay what is due to him.    But this does not mean that the employee needs to be injured in the workplace in order to avail of this claim.  You can also avail of the claim if in case you are on duty, then you is requested to get something for the company and you meet and accident, then you can avail of the insurance coverage.

An employee can also avail the benefit of this when he contracts any illness or disease caused by the work that he does or caused by any discomfort or working condition in the work place.    In the event that the employee is injured it does not matter whether whose fault it is as long as it is job related, the employee can still avail of the insurance coverage.  However, if the employee is drunk or is under the influence of any illegal drug, then he can never claim any payment.

In some cases, the employee files a suit against his employer in the event that he is injured.  There is no need for an employee to do this because as long as the injury is work related, he has the right to claim his benefits.  In the case that the employee files a suit against his employer in order to have him paid of his injury, he can no longer claim the workers compensation insurance benefits.  Instead he will wait for the decision of the court.  It is actually faster to claim the insurance coverage due you as an employee than to file a suit in court.
